TERMS OF USE / SERVICE AGREEMENT

These Terms of Use (“Agreement”) are entered into by and between PICKURPAGE LLP, a Limited Liability Partnership registered in India with its jurisdiction in Lucknow, Uttar Pradesh, (“PICKURPAGE”, “Company”, “we”, “us”, or “our”) and you, the individual or entity accessing or using Jhunkoo.ai or any related features, websites, applications, or content (collectively, the “Services”).

By using our Services, you agree to be bound by this Agreement. If you do not agree, do not use the Services.

1. Description of Service

Jhunkoo.ai is a software-as-a-service (SaaS) platform that enables individuals and businesses to create and deploy AI agents using built-in tools, APIs, and Retrieval-Augmented Generation (RAG) capabilities.

2. Eligibility

You must be at least 18 years old or have the legal capacity to enter into a binding agreement to use the Services.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. License and Restrictions

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business or personal purposes.

You agree not to:

  • Resell, sublicense, or commercially exploit the Services;
  • Reverse engineer or attempt to extract the source code;
  • Use the Services to violate any law or regulation.

5. Payment and Subscriptions

5.1 Billing

Payments are processed via Lemon Squeezy as our current Merchant of Record. This may change in the future, and any such changes will be updated in this document.

5.2 No Refunds

All payments are final. No refunds will be issued under any circumstances. If you cancel a subscription, it will remain active until the end of the current billing period.

6. Third-Party Services

Our Services may rely on or integrate with third-party providers such as OpenAI, Google, Pinecone, Groq, among others. We do not guarantee the availability, security, or performance of these third-party services and do not disclose the full list of services used.

7. Beta Features

You may be given access to beta or experimental features that are not yet fully tested. These features may be unstable or subject to change without notice. Use of such features is at your own risk.

8. Usage Limits and Fair Use Policy

To ensure reliable service for all users, we may apply usage limits based on your subscription plan. This includes, but is not limited to:

  • API call limits
  • Storage quotas
  • Rate limits for AI queries
  • Concurrent agent deployments

If your usage significantly exceeds normal usage patterns or negatively impacts other users or the system, we reserve the right to:

  • Throttle your access temporarily
  • Request you upgrade to a higher plan
  • Suspend or terminate your account if abuse continues

We monitor usage patterns and reserve the right to define “fair use” at our sole discretion.

9. Termination

We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for conduct that we believe violates this Agreement or is otherwise harmful to us or other users.

You may also terminate your use at any time by canceling your account.

10. Intellectual Property

All intellectual property rights in the Services, including but not limited to software, designs, trademarks, and content, are owned by or licensed to PICKURPAGE LLP. You may not use our branding without prior written permission.

11. Limitation of Liability

To the fullest extent permitted by law, PICKURPAGE LLP shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Services.

12. Indemnity

You agree to indemnify and hold harmless PICKURPAGE LLP, its affiliates, and employees from and against any claims, liabilities, damages, and expenses arising from your use of the Services or violation of this Agreement.

13. Jurisdiction and Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India, with exclusive jurisdiction in Lucknow, Uttar Pradesh.

14. Changes to the Terms

We may modify this Agreement at any time. We will notify users via email or through the platform. Continued use of the Services after changes indicates acceptance.
